Terms of Service

1. Acceptance of Terms

By accessing or using Domain Dumpster Dive ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. Domain Dumpster Dive is a domain name marketplace connecting sellers and buyers.

2. The 5% Below Market Guarantee

Every domain listed on Domain Dumpster Dive must be priced at least 5% below the lowest comparable listing on Afternic, Sedo, Flippa, Dan.com, GoDaddy, or Spaceship at the time of listing.

  • Sellers agree to this pricing requirement upon uploading domains.
  • We randomly audit 2–5 domains per upload batch to verify compliance.
  • Listings found in violation will be removed without notice.
  • Repeat violations may result in account suspension.

3. Seller Responsibilities

  • You must own or have full authority to sell any domain you list.
  • Listings must be accurate — domain name, TLD, and price must match exactly.
  • You are responsible for completing the domain transfer upon sale.
  • You may not list domains that infringe trademarks or third-party rights.
  • Fraudulent listings will result in immediate account termination.

4. Buyer Responsibilities

  • Domain Dumpster Dive is a marketplace platform that connects buyers and sellers and processes payments via Stripe.
  • You are responsible for conducting your own due diligence before purchasing.
  • We are not responsible for failed transfers or seller non-performance after payment is released.
  • Always verify domain ownership through your registrar before completing payment.
  • All sales are final once a domain transfer has been initiated.

5. No Guarantee of Sale

Listing a domain on Domain Dumpster Dive does not guarantee a sale. We make no representations about the value of any domain or the likelihood of finding a buyer. Domain Dumpster Dive is a marketplace platform only.

6. Prohibited Uses

You may not use the Service to:

  • List domains you do not own or have authority to sell.
  • Post false, misleading, or fraudulent listings.
  • Scrape, copy, or systematically extract listing data.
  • Attempt to bypass pricing verification systems.
  • Engage in any illegal activity under applicable law.

7. Limitation of Liability

Domain Dumpster Dive is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Domain Dumpster Dive shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to failed domain transfers, pricing disputes, or loss of business.

8. Payment Processing

All payments are processed by Stripe, Inc. By making a purchase, you also agree to Stripe's Terms of Service. Domain Dumpster Dive does not store credit card numbers or payment credentials. Refunds, if applicable, are issued at our sole discretion and processed through Stripe.

9. DMCA / Intellectual Property

If you believe a domain listing on this platform infringes your trademark or intellectual property rights, submit a written notice to [email protected] including:

  • Your contact information and a description of the IP right being infringed.
  • The specific domain name(s) you believe infringe your rights.
  • A statement that you have a good-faith belief the use is unauthorized.
  • A statement, under penalty of perjury, that the information is accurate.

We will review valid notices and remove infringing listings promptly.

10. Dispute Resolution & Arbitration

Any dispute arising from these Terms or your use of the Service shall first be addressed by contacting us at [email protected]. If not resolved within 30 days, disputes shall be settled by binding arbitration under the American Arbitration Association's Consumer Arbitration Rules.

Class action waiver: You agree to resolve disputes individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

11. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes not subject to arbitration shall be resolved in the state or federal courts located in Florida.

12. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will update the "Last updated" date at the top of this page when changes are made.
